03. AMA News: Head of Copyright Office Fired
Leadership Shakeup at the U.S. Copyright Office Raises Concerns
On Saturday, May 10th, Shira Perlmutter, the Register of Copyrights and Director of the U.S. Copyright Office, was terminated.
To quote The Washington Post: "This month, Perlmutter’s office released a more than 100-page report on artificial intelligence that raised concerns about using copyrighted materials to train AI systems, which some employees suspected may have influenced Perlmutter’s termination."
This leadership change comes at a deeply concerning time for those working to protect copyright, as the courts consider two pivotal cases that could reshape how copyrighted content is used online and in AI development:
Perfect 10 v. Google (9th Cir. 2007): The foundation of the controversial “server test,” which allows websites to embed images from other servers without violating the display right, a doctrine now under renewed scrutiny.
Grecco v. Valve (Pending SCOTUS Petition, 2024): A critical case examining whether companies that use copyrighted images to train AI models without a license are violating copyright law. The Supreme Court has been asked to review this case, which could have sweeping implications for artists across industries.
We will continue monitoring these developments closely and will keep you updated as more information becomes available.
