Under New York State Senate Bill S5026, effective from May 20, 2024, all freelance contracts in New York valued at $800 or more must include the following details:
The name and mailing address of both the hiring party and the contractor.
A detailed list of services provided by the contractor, including the value of these services.
The payment rate and method.
The deadline for payment by the hiring party, or the method for determining this date.
The deadline for the contractor to submit an invoice or list of services rendered.
A signature from the contractor, confirming agreement to the terms.
The above can be copied and used as the basis of agreements that you send to freelancers.
Freelancers are granted a 6-year period to file complaints regarding noncompliance with this law. Employers found repeatedly noncompliant may incur fines up to $25,000.
