UPDATE ON VACCINE LEGAL ISSUES

Hollywood’s unions, major studios and production companies have recently reached a deal that allows on a restricted basis Mandatory Covid-19 vaccinations on film and TV productions. IMG recently released a memo stating that only the fully vaccinated can attend NYFW. As vaccine mandates increase industry wide, many AMA members have received similar requests from contracting companies to have crew and talent show proof of vaccinations prior to coming on set.

In consultation with AMA Legal counsel, all the guidance suggests that vaccine mandates are allowed and that employers can require proof of vaccination before returning to the workplace. This includes production sets. Employees should make room for exemptions, if there are valid medical or religious reasons preventing vaccination. Reasonable accommodations need to be made for those and should be dealt with on a case-by-case basis with an attorney.

This information is designed as a service to the AMA community intended only to provide general information. We encourage you to speak to your legal representation and work with your clients to determine the best path forward for your productions.
